5. <br /> On April 28, 2017,Mayor Jack Hicks,on behalf of the Town of Haughton,executed a Bill <br /> of Sale for the 2007 Dodge Durango to the highest bidder, Blake McGinty, for the amount of <br /> $1,600.00. The Bill of Sale was notarized by Reagan Currence as Town Clerk. <br /> 6. <br /> On April 28, 2017, Blake McGinty executed an Act of Donation of a Movable to transfer <br /> the 2007 Dodge Durango to Joseph G. Currence. The Act of Donation of a Movable was notarized <br /> by Reagan Currence. <br /> 7. <br /> On April 28, 2017, Blake McGinty signed the Title of the 2007 Dodge Durango indicating <br /> a transfer of ownership to Joseph G. Currence. The Title transfer was notarized by Reagan <br /> Currence. <br /> 8. <br /> La. R.S. 42:1115A(1)provides: <br /> No public servant shall solicit or accept, directly or indirectly, anything of <br /> economic value as a gift or gratuity from any person, or from any officer, director, <br /> agent, or employee of such person, if such public servant knows or reasonably <br /> should know that such person has or is seeking to obtain contractual, or other <br /> business or financial relationships with the public servant's agency. <br /> 9. <br /> Based on the foregoing facts,Reagan Currence,while employed by the Town of Haughton <br /> as the Town Clerk, violated La. R.S. 42:1115A(1) when she indirectly received a donation of the <br /> surplus 2007 Dodge Durango from Blake McGinty, when she knew that Blake McGinty had, or <br /> was seeking to obtain, a contractual, business, or other financial relationship with her agency, the <br /> Town of Haughton. <br /> Page 2 of 4 (Docket No. 2018-963) <br />
