9. <br /> La. R.S. 42:1111A provides that no public servant shall receive anything of economic <br /> value, other than compensation and benefits from the governmental entity to which he is duly <br /> entitled, for the performance of the duties and responsibilities of his office or position. <br /> 10. <br /> La. R.S. 42:1111C(1)(a) provides no public servant shall receive any thing of economic <br /> value for any service, the subject matter of which is devoted substantially to the responsibilities, <br /> programs, or operations of the agency of the public servant and in which the public servant has <br /> participated. <br /> 11. <br /> La. R.S. 42:1111C(2)(b) provides that no public servant and no legal entity in which the <br /> public servant exercises control or owns an interest in excess of twenty-five percent, shall <br /> receive any thing of economic value for or in consideration of services rendered, or to be <br /> rendered, to or for any person during his public service unless such services are not within the <br /> course of his official duties. <br /> 12. <br /> Based on the foregoing facts, Dan Klein, Jr., while serving as Deputy Sheriff and Animal <br /> Control Officer of the West Feliciana Parish Sheriffs Office, violated La. R.S. 42:1111A(1)(a), <br /> La. R.S. 42:1111C(1)(a), and La. R.S. 42:1111C(2)(b) by his receipt of five thousand two <br /> hundred fifty dollars ($5,250.00) for the rental of live animal traps; the removal of nuisance <br /> animals; and, the capture and removal of hogs from Entergy's River Bend station for services <br /> that were within the course and scope of his official duties as an Animal Control Officer; by <br /> receiving compensation for services that are a part of the responsibilities and operations of the <br /> 3 <br />
