Advisory opinion that the Lacombe Booster Club, whose president is a former member of the St. Tammany Recreation District No. 4 (District), would not be prohibited by the Louisiana Code of Governmental Ethics from transacting with the District through a Memorandum of Understanding with the District since the Lacombe Booster Club would not be assisting another person for compensation in a transaction with the District.

following the termination of his public service, assist another person, for compensation, in a <br /> transaction,or in an appearance in connection with a transaction in which such public servant at any <br /> time participated during his public service and involving the agency by which he was formerly <br /> employed or in which he formerly held office. While the Boosters are a separate legal entity of <br /> which Mr. Leary is an officer the Boosters are not assisting another person for compensation in a <br /> transaction with the District and as such are not prohibited from entering into a Memorandum of <br /> Understanding with the District. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics.
