VI. <br /> Kivett's Electrical Heating and Cooling Services was paid $5,248.39 on April 29, 2013 <br /> by the Richmond Sports Complex bank account on check number 1133 for the air conditioning <br /> work. Robert Kivett, Sr. signed check number 1133 made payable to Kivett's Electrical Heating <br /> and Cooling Services. <br /> VII. <br /> La. R.S.42:1113 provides with respect to prohibited transactions as follows: <br /> A. (1)(a)No public servant... or legal entity in which he has a <br /> controlling interest, shall bid on or enter into any contract, <br /> subcontract, or other transaction that is under the supervision <br /> or jurisdiction of the agency of such public servant. <br /> VIII. <br /> Based on the foregoing facts, Kivett's Electrical Heating and Cooling Services violated <br /> La. R.S. 42:1113A(1)(a) when it entered into a transaction with the Village of Richmond to <br /> install air conditioning at the concession stand of the Richmond Sports Complex, when such <br /> transaction was under the supervision or jurisdiction of the agency of Robert Kivett, Sr. the <br /> Mayor of the Village of Richmond, and at a time when Kivett's Electrical Heating and Cooling <br /> Services was owned by the biological sons of Robert Kivett, Sr. <br /> IX. <br /> La. R.S. 42:1153 provides with respect to penalties: <br /> B. Upon finding that any public employee or other person has <br /> violated any provision of any law within the jurisdiction of the board . . ., <br /> the board by a majority vote of the membership, may remove, suspend, or <br /> order a reduction in pay, or demotion of the public employee or other <br /> person,or impose a fine of not more than ten thousand dollars,or both. <br /> La.
