Advisory opinion that the Code of Governmental Ethics would not prohibit the daughter of the Chairman of the Bayou Blue Fire District ‎(Fire District)‎ from being compensated by the Fire District, since she was employed for more than one year prior to her father becoming the agency head. Further, her father would be prohibited by La. R.S. 42:1112B‎(1)‎ from participating in any transaction in which she had a substantial economic interest.

42:1119C(2) would allow Ms. Clement to remain employed by the Fire Department and receive <br /> normal promotional advancements.As such,she would not be prohibited from being a compensated <br /> employee of the Fire Department. <br /> If Ms. Clement is hired by the Fire Chief while Mr. Culhane serves on the Fire District Board,then <br /> Mr. Culhane would be prohibited from participating in any transaction in which Ms. Clement has <br /> a substantial economic interest. La. R.S. 42:1112B(1) provides that no public servant shall <br /> participate in a transaction involving the governmental entity in which,to his actual knowledge,any <br /> member of his immediate family has a substantial economic interest. A disqualification plan in <br /> accordance with the Rules of Board of Ethics enclosed with this opinion should be submitted for the <br /> Board's approval. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different application of the provisions of the Code of Ethics. The Board issues no <br /> opinion as to past conduct or laws other than Code of Governmental Ethics.
