Caption
Advisory opinion that a former Town of Slaughter Alderman would be prohibited by the Code of Governmental Ethics from being appointed by the Slaughter Board of Aldermen to fill a vacany for Slaughter Chief of Police, but would not be prohibited from being appointed by the Governor of Louisiana to fill such vacancy. The appointment by the Governor would not prohibit the appointed person from being eligible or qualifying in the next election as a candidate for the office.

Robert Jackson <br /> August 18, 2017 <br /> Page -2- <br /> La R.S.42:1121A(2)prohibits a former member of a board or commission,for aperiod of two years <br /> following the termination of his public service on such board or commission from being appointed <br /> to any position by that board or commission. Therefore,because Dave Almond's termination of his <br /> public service as a Slaughter Alderman would be less than two years from his appointment, the <br /> Slaughter Board of Aldermen could not appoint him to any position by that board. Since the Town <br /> of Slaughter is not involved in the governor's powers to appoint, La. R.S. 42:1121A(2) would not <br /> prohibit Dave Almond from being appointed by the governor to fill the vacancy for the Slaughter <br /> Police Chief. <br /> The Board further concluded that the prohibition against an appointed person being eligible or <br /> qualifying in the next election as a candidate for the office to which he is appointed would not apply <br /> in the event of a gubernatorial appointment. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics.
