A <br /> or reimbursed in whole or in part with federal funds distributed, paid, or allocated to or by the <br /> state or a state department, agency, or official. However, La. R.S. 42:114.3A(3) provides an ex- <br /> ception for construction-related contracts entered into with entities more than two years follow- <br /> ing the initial declaration of disaster or emergency,provide that the entity is not the governmen- <br /> tal entity of the legislator. In this specific instance, since the project is more than two years after <br /> the initial declaration of disaster, and does not involve Rep. DeVillier's governmental entity, <br /> DeVillier House Movers would not be prohibited from entering into the contract to perform the <br /> house elevation project. <br /> The Board further concluded, and instructed me to inform you, that La. R.S. 42:1114.3A(5) <br /> would require Rep. DeVillier to disclose any compensation that he receives, directly or through <br /> DeVillier House Movers, through any contract that is funded in whole or in part by federal <br /> funds. The initial disclosure is required no later than thirty (30) days after the contract is entered <br /> into,with subsequent disclosures to be filed annually by May 15th of each year that the contract <br /> is in effect. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as pre- <br /> sented may result in a different application of the provisions of the Code of Governmental Eth- <br /> ics. The Board issues no opinion as to past conduct or as to laws other than the Code of Gov- <br /> ernmental Ethics, the Campaign Finance Disclosure Act, the Lobbyist Disclosure Act, and con- <br /> flict of interest provisions in the gaming laws.
