i <br /> 7. <br /> La. R.S. 42:1111C(2)(d)provides that no public servant and no legal entity in which the <br /> public servant exercises control or owns an interest in excess of twenty-five percent, shall receive <br /> any thing of economic value for or in consideration of services rendered,or to be rendered,to or for <br /> any person during his public service unless such services are neither performed for nor compensated <br /> by any person from whom such public servant would be prohibited by La.R.S.42:1115(A)(1)or(B) <br /> from receiving a gift. <br /> 8. <br /> La. R.S. 42:1115B(1)prohibits a public employee from soliciting or accepting, directly or <br /> indirectly, any thing of economic value as a gift or gratuity from any person or from any officer, <br /> director,agent,or employee of such person,if suchpublic servant knows or reasonably should know, <br /> that such person conducts operations or activities that are regulated by the public employee's agency. <br /> 9. <br /> Further,La.R.S.42:1153(B)provides,with respect to penalties,that upon finding that any <br /> public employee or other person has violated any provision of any law within the jurisdiction of the <br /> board . . ., the board by a majority vote of the membership, may remove, suspend, or order a <br /> reduction in pay,or demotion of the public employee or other person,or impose a fme of not more <br /> than ten thousand dollars,or both. <br /> 10. <br /> Additionally,La.R.S.42:1155(A)provides,with respect to penalties,that if an investigation <br /> pursuant to R.S.42:1141 reveals that any public servant or other person has violated any law within <br /> the jurisdiction of the board to his economic advantage, the board may order the payment of <br /> penalties. Recovery may include, in addition to an amount equal to such economic advantage, <br /> penalties not to exceed one half of the amount of the economic advantage. <br /> 11. <br /> As evidenced by his signature below, Christopher Weddle knowingly, and of his own free <br /> will (a) agrees that the charges are factually supported by stated facts herein; (b) agrees that he <br /> violated La. R.S. 42:1111C(2)(d); (c)waives his right of appeal; (d) acknowledges that upon his <br /> signature being affixed to this consent decree, this document will be available to the public as a <br /> public record;(e)agrees that this order and decree is final,waives his right of appeal or to otherwise <br /> seek a return of the payment as the penalty; and, (f) agrees to pay the penalty assessed herein and <br /> otherwise to comply with any other term or condition in the following order and decree. <br /> Page 2 of 6 <br />
