Advisory opinion that the Code of Governmental Ethics would not prohibit doctors who serve as the medical director of the St. Mary Parish Drug Court or who provide medical services to St. Mary Parish employees and their dependents from being appointed as Deputy Coroners of St. Mary Parish. However, they would be prohibited from receiving compensation from any person who received services from them as Deputy Coroner and which involve the operations or programs of the St. Mary Parish Coroner's Office. Additionally, they would be prohibited from providing services through St. Mary Parish Coroner's Office in which people listed in La. R.S. 42:1112 have a substantial economic interest.

in a transaction involving the governmental entity in which, to his actual knowledge, any of the <br /> following persons has a substantial economic interest: any member of his immediate family; any <br /> person in which he has a substantial economic interest of which he may be reasonably be expected <br /> to know; any person with whom he is negotiating or has an arrangement concerning prospective <br /> employment;and,any person who is a party to an existing contract with such public servant,or who <br /> owes any thing of economic value to such public servant. <br /> Dr.Albert and Dr. Morice would be prohibited from receiving compensation from any person who <br /> received services from them as Deputy Coroners and in which such services involve the <br /> responsibilities, operations, or programs of the St. Mary Parish Coroner's Office. La. R.S. <br /> 42:1102(16)provides that"person"means an individual or legal entity other than a governmental <br /> entity;or agency thereof.Further,they would be prohibited from providing services through the St. <br /> Mary Parish Coroner's Office in which any of the people listed in La.R.S.42:1112 had a substantial <br /> economic interest. Dr.Lianter Albert should contact the Attorney General's Office concerning the <br /> application of Dual Office Holding Laws under its jurisdiction. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different application of the provisions of the Code of Ethics. The Board issues no <br /> opinion as to past conduct or laws other than Code of Governmental Ethics.
