Disapproval of a disqualification plan submitted by the 15th JDC District Attorney's Office concerning it entering into a transaction with Liberty National when the spouse of the Administrator of the Vermilion Parish Office is a commission based employee of Liberty National. La. R.S. 42:1111C(2)(d) would prohibit the spouse from receiving compensation from Liberty National while it has or is seeking to have a business, contractual, or other financial relationship with the 15th JDC District Attorney's Office.

While this disqualification plan avoids the potential conflict of interest contemplated in La. R.S. <br /> 42:1112B(1), it does not resolve the conflict of interest in La. R.S. 42:1111C(2)(d). La. R.S. <br /> 42:1111 C(2)(d) provides that no public servant shall receive any thing of economic value for or <br /> in consideration of services rendered, or to be rendered, to or for any person during his public <br /> service unless such services are neither performed for nor compensated by any person from <br /> whom such public servant would be prohibited by La. R.S. 42:1115A(1) or (B) from receiving a <br /> gift. Mr. Manceaux would be prohibited from receiving compensation from Liberty National <br /> while Liberty National had or is seeking to obtain a contractual or other business or financial <br /> relationships with Mrs. Manceaux's agency. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts <br /> presented may result in a different application of the provisions of the Code of Ethics.
