Advisory opinion that the Louisiana Code of Governmental Ethics would not prohibit ESTEEM Youth Programs, Inc., from being licensed by the Louisiana Department of Health (LDH) while its owner is employed as a Program Manager 1 of the Coordinated System of Care within LDH, since the agency the program manager is employed by would not be involved in the licensing nor in the payment of funds to or for ESTEEM. However, La. R.S. 42:1111C(2)(d) might prevent the program manager from receiving compensation from ESTEEM in the future.

R.S. 42:1111C(2)(d)may be applicable. La. R.S. 42:1111C(2)(d) <br /> prohibits a public servant and a legal entity in which the public servant exercises control or owns an <br /> interest from receiving any thing of economic value for services rendered to or for any person during <br /> his public service unless such services are neither performed for nor compensated by any person who <br /> has or is seeking to have a contractual, business or financial relationship with the public servant's <br /> agency;conducts operations or activities that are regulated by the public employee's agency;or has <br /> a substantial economic interest which may be substantially affected by the performance or non <br /> performance of the public employee's official duty. Prior to receiving any thing of economic value <br /> from ESTEEM in the future you should request another advisory opinion. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different application of the provisions of the Code of Ethics.
