Turlich, Jr. <br /> Sheriff and Tax Collector's Office <br /> 8022 Highway 23 <br /> Belle Chasse, Louisiana 70037 <br /> Re: Ethics Board Docket No. 2018-511 <br /> Dear Sheriff Turlich: <br /> The Louisiana Board of Ethics, at its June 15, 2018 Board meeting, considered your request for <br /> an advisory opinion regarding whether the employees of the Plaquemines Parish Sheriff's Office <br /> (PPSO) may use The Ferry Stop, which is owned by a full-time employee of PPSO and his wife, <br /> to refuel their departmental vehicles. You stated that Urban Treuil is an employee of PPSO who <br /> is assigned to the Patrol Division- District 3, which is located on the east bank of Plaquemines <br /> Parish. He does not supervise any employees but is assigned a departmental vehicle. Mr. Treuil <br /> and his wife own The Ferry Stop. <br /> PPSO maintains approximately two hundred eighteen (218) vehicles, of which twenty-eight (28) <br /> are assigned to the east bank between the Patrol Division- District 3 and the Plaquemines Parish <br /> Detention Center. You estimate that approximately three thousand three hundred eighty-five <br /> (3,385) gallons of fuel per month would be purchased from The Ferry Stop if such purchases <br /> were not prohibited. The next nearest fueling station near the north end of the parish is located <br /> approximately 1.3 miles into St. Bernard Parish; however, this fueling station is not a 24 hour <br /> facility like The Ferry Stop. <br /> The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics <br /> would prohibit The Ferry Stop from selling fuel for Patrol Division- District 3 departmental <br /> vehicles while Urban Treuil is employed by the Division. La. R.S. 42:1113A(1)(a) prohibits <br /> public servants, or members of such a public servant's immediate family, or a legal entity in <br /> which he has a controlling interest from bidding on or entering into any contract, subcontract, or <br /> other transaction that is under the supervision or jurisdiction of the agency of such public <br /> servant. Urban Treuil`s agency is the Patrol Division- District 3. Only the employees of this <br /> District would be prohibited from purchasing fuel for their departmental vehicles from The Ferry <br /> Stop. Any other departmental vehicles not within Mr. Treuil's agency would not be prohibited <br /> from being fueled at The Ferry Stop. <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
