The Code of Governmental Ethics would not prohibit Gene Gibson, the brother of the Fire Chief of Webster Parish Fire Protection District No. 8, from being appointed to the Board of Commissioners of the Fire District, since he is a volunteer who receives no compensation for the firefighting services and Terry Gibson has been employed with the Fire District longer than one year.

Mr. Perry Kirkland <br /> December 17, 2018 <br /> Page -2- <br /> employment" shall include any decision involving the employment, promotion, <br /> discipline, discharge, or assignment of the firefighter. <br /> The Board concluded, and instructed me to inform you, that the Code would not prohibit Gene <br /> Gibson, the brother of Fire Chief Terry Gibson, from being appointed to the Board of <br /> Commissioners of the Fire District,while Terry Gibson serves as Fire Chief of the Fire District,since <br /> he is a volunteer who receives no compensation for the firefighting services and Terry Gibson has <br /> been employed with the Fire District longer than one year. <br /> Finally,the Board did want me to caution you that La.R.S.42:1112B prohibits a public servant from <br /> participating in a transaction in which the public servant or member of his immediate family has a <br /> substantial economic interest. Gene Gibson would be prohibited by the Code from participating in <br /> any transaction in which Terry Gibson has a substantial economic interest. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different application of the provisions of the Code of Ethics. The Board issues no <br /> opinion as to past conduct or laws other than Code of Governmental Ethics.
