R.S. 42:1111C(2)(d) prohibits a public servant from receiving anything of economic value for <br /> services provided to a person who has, or is seeking to obtain, a contractual, business, or finan- <br /> cial relationship with the public servant's agency. <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you, that, as Principal,your agency is Benton <br /> Middle School. Therefore, you would be prohibited by Section 1111C(1)(a) from providing <br /> teacher development services through Solution Tree to faculty members of Benton Middle <br /> School, since you have participated in providing those services in your public capacity. However, <br /> you would not be prohibited by Section 1111C(1)(a) from providing teacher development ser- <br /> vices through Solution Tree, to teachers who are not employed at Benton Middle School. <br /> The Board further concluded, and instructed me to inform you, that you would not be prohibit- <br /> ed by Section 1111C(2)(d) from performing compensated services for Solution Tree, since Solu- <br /> tion Tree does not currently have a contract, business, or financial relationship with Benton <br /> Middle School. <br /> Please be aware that the application of Section 1111C(2)(d) may change in the event Solution <br /> Tree obtains, or seeks to obtain, a future contractual relationship with Bossier Parish School <br /> Board to provide services to Benton Middle School. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as pre- <br /> sented may result in a different application of the provisions of the Code of Governmental Eth- <br /> ics. The Board issues no opinion as to past conduct or as to laws other than the Code of Gov- <br /> ernmental Ethics, the Campaign Finance Disclosure Act, the Lobbyist Disclosure Act, and con- <br /> flict of interest provisions in the gaming laws.
