(2) The agency head approved the public servant's acceptance of complimentary admission, lodging, and reasonable transportation, or reimbursement for such expenses,prior to acceptance. CONCLUSION The Board concluded,and instructed me to inform you,that the Code of Governmental Ethics would not prohibit the three employees of the District, the Executive Director of the District, Nicholas Gernon,Commander of the New Orleans Police Department's 8th District and Kristin Palmer,a New Orleans City Councilwoman from receiving complimentary airfare, lodging and meals to travel to the City of Amsterdam since the French Quarter Management District is a governmental entity. Further,the attendees would not be required to file a disclosure statement with the Board of Ethics pursuant to La. R.S. 42:1115.2. However, the Board will not address whether or not this is an appropriate use of public funds as this issue is not under the jurisdiction of the Board and such inquiry should be directed to the local District Attorney or the Attorney General. This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as presented may result in a different application of the provisions of the Code of Ethics.
