April 16, 2019 <br /> Ethics Board Docket No. 2019-332 <br /> Ms. Emily Remington <br /> Page 2 <br /> or reimbursement for such expenses,if the agency head of the public servant's agency certifies each <br /> of the following: <br /> (1) The public servant's acceptance of complimentary admission, lodging, and <br /> reasonable transportation, or reimbursement for such expenses, is either of direct <br /> benefit to the agency or will enhance the knowledge or skill of the public servant as <br /> it relates to the performance of his public service. <br /> (2) The agency head approved the public servant's acceptance of complimentary <br /> admission, lodging, and reasonable transportation, or reimbursement for such <br /> expenses,prior to acceptance. <br /> CONCLUSION <br /> The Board concluded,and instructed me to inform you,that the Code of Governmental Ethics would <br /> not prohibit the three employees of the District, the Executive Director of the District, Nicholas <br /> Gernon,Commander of the New Orleans Police Department's 8th District and Kristin Palmer,a New <br /> Orleans City Councilwoman from receiving complimentary airfare, lodging and meals to travel to <br /> the City of Amsterdam since the French Quarter Management District is a governmental entity. <br /> Further,the attendees would not be required to file a disclosure statement with the Board of Ethics <br /> pursuant to La. R.S. 42:1115.2. However, the Board will not address whether or not this is an <br /> appropriate use of public funds as this issue is not under the jurisdiction of the Board and such <br /> inquiry should be directed to the local District Attorney or the Attorney General. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics. The Board <br /> issues no opinion as to past conduct or as to laws other than the Code of Governmental Ethics.
