Advisory Opinion whereby the Code of Governmental Ethics would not prohibit the continued employment of the daughter of James Clarke with the University of Louisiana at Lafayette if James Clarke is appointed to the Board of Supervisors for the University of Louisiana System since she has been employed for at least one (1) year prior to Clarke becoming an agency head by virtue of his appointment to the Baord of Supervisors for the University of Louisiana System.

Clarke <br /> June 25, 2019 <br /> Page 2 <br /> CONCLUSION <br /> The Board concluded,and instructed me to inform you,that the Code of Governmental Ethics would <br /> not prohibit the continued employment of your daughter with the University of Louisiana at <br /> Lafayette if you are appointed to the Board of Supervisors for the University of Louisiana System <br /> since she has been employed for at least one(1)year prior to you becoming an agency head by virtue <br /> of your appointment to the Board of Supervisors for the University of Louisiana System. However, <br /> the Board directed the staff to advise you that you would be prohibited from participating as a <br /> member of the Board of Supervisors for the University of Louisiana System in any transactions in <br /> which your daughter has a substantial economic interest. La. R.S. 42:1120.4 allows you to recuse <br /> yourself from the vote, discussion and debate of any matter in which your daughter may have a <br /> substantial economic interest to avoid a violation of La. R.S. 42:1112B(1). <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics. The Board <br /> issues no opinion as to past conduct or as to laws other than the Code of Governmental Ethics.
