Mr. Kevin Kinslow
July 22, 2019
Page -2-
from the original advisory opinion, in that the Fire Chief no longer supervises the maintenance
employees, the duties of the officers of the BVVFD overlap those of the maintenance employees.
Specifically, both are charged with maintaining the equipment located at the BVVFD. Because the
Fire Chief, and in his absence, the Assistant Fire Chief are required to maintain the department's
equipment, they cannot receive a thing of economic value in the form of maintenance workers'salary
for the operations of the agency for which they have participated.
The Board further concluded and instructed me to inform you, that the Code of Governmental Ethics
would not prohibit you from responding to an emergency call as a volunteer fireman for the BVVFD
while you are employed as a compensated maintenance employee with the St. Mary Parish Fire
Protection District No. 7. Since the duties of the maintenance worker and a volunteer fireman are
not the same, the Code of Governmental Ethics would not prohibit the maintenance employees from
answering emergency calls as a volunteer fireman for the BVVFD.
This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented
may result in a different application of the provisions of the Code of Ethics. The Board issues no
opinion as to past conduct or laws other than the Code of Governmental Ethics. If you have any
questions, please contact me at(225)219-5600 or(800) 842-6630.
Sincerely,
LOUISIANA BOARD OF ETHICS
Gregory L. Thibodeaux
For the Board
