Mr. Kevin Kinslow <br /> July 22, 2019 <br /> Page -2- <br /> from the original advisory opinion, in that the Fire Chief no longer supervises the maintenance <br /> employees, the duties of the officers of the BVVFD overlap those of the maintenance employees. <br /> Specifically,both are charged with maintaining the equipment located at the BVVFD. Because the <br /> Fire Chief, and in his absence, the Assistant Fire Chief are required to maintain the department's <br /> equipment,they cannot receive a thing of economic value in the form of maintenance workers'salary <br /> for the operations of the agency for which they have participated. <br /> The Board further concluded and instructed me to inform you,that the Code of Governmental Ethics <br /> would not prohibit you from responding to an emergency call as a volunteer fireman for the BVVFD <br /> while you are employed as a compensated maintenance employee with the St. Mary Parish Fire <br /> Protection District No. 7. Since the duties of the maintenance worker and a volunteer fireman are <br /> not the same,the Code of Governmental Ethics would not prohibit the maintenance employees from <br /> answering emergency calls as a volunteer fireman for the BVVFD. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different application of the provisions of the Code of Ethics. The Board issues no <br /> opinion as to past conduct or laws other than the Code of Governmental Ethics.
