Ethics Board Docket No. 2019-495 <br /> Mr. Roderick G. Bertrand <br /> July 24, 2019 <br /> Page 2 <br /> La. R.S. 42:1112B(3) states that no public servant shall participate in a transaction involving the <br /> governmental entity in which,to his actual knowledge,any person of which he is an officer,director, <br /> trustee,partner, or employee has a substantial economic interest. <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you, that La. R.S. 42:1111C(2)(d) of the Code <br /> of Governmental Ethics would prohibit Mr. Reeves from receiving any thing of economic value <br /> (compensation)for services rendered to the Louisiana Rural Water Association as Deputy Director <br /> if he is elected to the Allen Parish Police Jury and if the Louisiana Rural Water Association is <br /> providing any services to any local water districts that were created by the Allen Parish Police Jury. <br /> La. R.S. 42:1112B(3) would prohibit Mr. Reeves from participating in any transaction involving <br /> Louisiana Rural Water Association and Allen Parish, including any water district created by Allen <br /> Parish,in which the Louisiana Rural Water Association has a substantial economic interest. La.R.S. <br /> 42:1120 provides that an elected official shall recuse himself from the vote to avoid a violation of <br /> La.R.S.42:1112;and,the elected official shall not be prohibited from participating in the discussion <br /> and debate concerning the matter provided the elected official makes a disclosure of the conflict of <br /> interest or potential conflict of interest a part of the record of his agency prior to his participation in <br /> the discussion or debate and prior to the vote. <br /> In addition,La.R.S. 42:1113A would prohibited Mr.Reeves from providing services himself as an <br /> employee of the Louisiana Rural Water Association to any local water district created by Allen <br /> Parish Police Jury if he is elected to the Allen Parish Police Jury. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics. The Board <br /> issues no opinion as to past conduct or as to laws other than the Code of Governmental Ethics.
