La. R.S. 1111C(2)(d) prohibits a public servant and any legal entity in which the public servant exercises <br /> control or owns an interest in excess of twenty-five percent, from receiving anything of economic value <br /> for services rendered from a person who has or is seeking to obtain contractual or other business or <br /> financial relationships with the public servant's agency. <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics would not <br /> prohibit Lance Ledford from contracting with the District to provide regular and routine maintenance on <br /> fire trucks and other emergency vehicles while he serves as a volunteer firefighter, provided he continues <br /> to receive only payment from the District for costs associated with his service and not for his time as a <br /> fireman, as allowed by the exception found in La. R.S. 42:1123(35). <br /> The Board further concluded, and instructed me to inform you, that the Code of Governmental Ethics <br /> would not prohibit Mitchell Nunn from volunteering his services to assist with the maintenance of District <br /> vehicles, as La. R.S. 42:1123(30) provides an exception which allows him to donate his services to his <br /> agency. <br /> Finally, the Board concluded, and instructed me to inform you, that La. R.S. 42:1111C(2)(d) prohibits <br /> Mitchell Nunn from receiving compensation from Lance Ledford to assist him with regular and routine <br /> maintenance on fire trucks and other emergency vehicles through a contract with the District. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented may <br /> result in a different application of the provisions of the Code of Ethics. The Board issues no opinion as to <br /> past conduct or laws other than Code of Governmental Ethics.
