La.R.S.42:1115A(1)prohibits a public servant from soliciting or accepting,directly or indirectly, <br /> any thing of economic value as a gift or gratuity from any person or from any officer, director, <br /> agent, or employee of such person, if such public servant knows or reasonably should know that <br /> such person has or is seeking to have a contractual, business or financial relationship with the <br /> public servant's agency. <br /> CONCLUSION <br /> The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics <br /> would prohibit Ms. Reiners from providing professional development services through Teaching <br /> Lab to the Lafayette Parish School System or other school systems. Such an arrangement would <br /> constitute a prohibited source under La.R.S. 42:1111 C(2)(d),which prevents public servants from <br /> receiving any thing of economic value for or inconsideration of services rendered, or to be <br /> rendered, to or for any person during his public service unless such services are neither performed <br /> for nor compensated by any person from whom the public servant would be prohibited by La. R.S. <br /> 42:1115A(1) or (B) from receiving a gift. La. R.S. 42:1115A(1) restricts public servants from <br /> receiving any thing of economic value as a gift from a person who has or is seeking to obtain a <br /> contractual or other business or financial relationship with the public servant's agency. Ms. <br /> Reiner's agency is the Lafayette Parish School System, which has such a contractual relationship <br /> with Teaching Lab; therefore, she is prohibited from receiving any thing of economic value for <br /> services rendered to Teaching Lab, regardless of whether the services would be provided to the <br /> Lafayette Parish School System or other school systems. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different application of the provisions of the Code of Ethics. The Board issues no <br /> opinion as to past conduct or laws other than Code of Governmental Ethics.
