prohibited by the provisions of this subsection; however, no such contract shall be
renewed except as specifically provided for in this Paragraph.
CONCLUSION
The Board concluded, and instructed me to inform you, that since the professional services
agreement with the Attorney General's Office was not prohibited at the time it was entered
into, Section 1113D would not prohibit your completion of the agreement. However, both
yourself and your law firm would be prohibited from renewing the professional services
agreement, or entering into a new agreement, after you are sworn into office as State
Representative.
Further, while the agreement is being completed, you are required by La. R.S.
42:1113D(4)(a) to file a disclosure statement with the Board of Ethics by May 15t11 of each
year of your term of office, identifying the parties to and the value and term of each contract
between yourself or law firm and the state government during the previous calendar year.
Disclosure Form 411 can be found at ethics.la.gov.A copy is enclosed for your reference.
This advisory opinion is based solely on the facts as set forth herein. Changes to the facts
as presented may result in a different application of the provisions of the Code of
Governmental Ethics. The Board issues no opinion as to past conduct or as to laws other
than the Code of Governmental Ethics, the Campaign Finance Disclosure Act,the Lobbyist
Disclosure Act, and conflict of interest provisions in the gaming laws. If you have any
questions, please contact me at(800)842-6630 or(225)219-5600.
Sincerely,
LOUISIANA BOA OF ETHICS
David M.
