Ieyoub <br /> December 30, 2019 <br /> Page-2- <br /> person: (1) conducts operations or activities which are regulated by the public employee's agency <br /> or, (2) has substantial economic interests which may be substantially affected by the performance <br /> or nonperformance of the public employee's official duty. <br /> CONCLUSION <br /> The Board concluded and instructed me to inform you, the Code of Governmental Ethics (Ethics <br /> Code)would not prohibit the State of Montana from donating the rights and a copy of the software <br /> to the State of Louisiana because the State of Montana is a governmental entity and not a person <br /> under the Ethics Code. Further, the Board concluded and instructed me to inform you, the Ethics <br /> Code would not prohibit LMOGA Foundation from donating its services to modify the software so <br /> that it can be utilized by the State of Louisiana. Under the facts provided, LMOGA Foundation <br /> conducts no operations in the State of Louisiana that would subject it to the jurisdiction or regulatory <br /> oversight of the OOC and no person is benefitting from the donation, only the OOC. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different application of the provisions of the Code of Ethics. The Board issues no <br /> opinion as to past conduct or laws other than the Code of Governmental Ethics.
