CONCLUSION
The Code of Governmental Ethics would prohibit an immediate family member of a principal to
be employed as a certified classroom teacher at the principal's school as a new hire. While La.
R.S. 42:1119B(2)(a)(i) does provide an exception for an immediate family member of a school
board member or of the school system's superintendent to be employed as classroom teacher
provided that such a family member is certified to teach or is temporarily authorized to teach while
pursuing certification, this exemption does not extend to immediate family members of a school's
principal. The submission of a disqualification plan to the Board would not remedy this statutory
prohibition. In the event that the immediate family member of a principal has been employed at
the school for at least one year prior to his or her family member becoming principal, La. R.S.
42:1119C(2)would allow for their continued employment and normal promotional advancements.
This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented
may result in a different application of the provisions of the Code of Ethics. The Board issues no
opinion as to past conduct or laws other than Code of Governmental Ethics. If you have any
questions,please contact me at(225)219-5600 or(800) 842-6630.
Sincerely,
LOUISIANA BOARD OF ETHICS
DA
aktt ekw R. DeVille
For the Board
