CONCLUSION <br /> The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics <br /> would prohibit the Village of Mooringsport from hiring Ms. Dearing as a contract employe but <br /> would not prohibit her serving as a part-time employee. La. R.S. 42:1121A(1) prohibits former <br /> elected officials from rendering any service on a contractual basis to or for their former agency for <br /> a period of two years following the termination of their public service; therefore, Ms. Dearing <br /> would not be eligible to serve as a contract employee until December 31, 2020. However, there is <br /> no statutory prohibition against a former elected official, other than a member of a board or <br /> commission, serving as a part-time public employee with their former agency. Accordingly, the <br /> Village of Mooringsport is free to hire Ms. Dearing in this capacity provided she receives a W-2 <br /> Form from the village. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different application of the provisions of the Code of Ethics. The Board issues no <br /> opinion as to past conduct or laws other than Code of Governmental Ethics.
