5. <br /> On three occasions between June 20, 2014 and November 19, 2015, Daniel Eitmann <br /> received three payments totaling$4,5000 from Band Boosters in connection with the creation of <br /> the band's halftime performances,including the music and choreography. <br /> 6. <br /> La. R.S. 42:1111A(1)(a) provides that no public servant shall receive anything of <br /> economic value,other than compensation and benefits from the governmental entity to which he <br /> • <br /> is duly entitled,for the performance of the duties and responsibilities of his office or position. <br /> 7, • <br /> La. R.S.42:1153B provides with respect to penalties: <br /> Upon a determination that any public employee or other person has <br /> violated any provision of any law within the jurisdiction of the Board of <br /> Ethics ... the Ethics Adjudicatory Board may remove, suspend, or order a <br /> reduction in pay, or demotion of the public employee or other person, or <br /> impose a fine of not more than ten thousand dollars,or both. <br /> 8. <br /> If called to testify, Daniel Eitmann would state that he did not intend to violate the Code <br /> of Governmental Ethics. <br /> 9. <br /> If called to testify, Daniel Eitmann would state that the Northshore High School <br /> Administration had knowledge of the payment arrangements, and approved of the payment <br /> system,prior to his receipt of the payments. <br /> 10. <br /> If called to testify, Daniel Eitmann would state that he was informed by the Northshore <br /> High School Administration that he was allowed to receive payments from Northshore High <br /> School Band Boosters,Inc.in connection with his duties at the Northshore High School Band. <br /> Page 2 of 6(Docket No.2017-652) <br />
