Ethics Board Docket No. 2020-433
Mayor Xanthe V. Seals
July 7, 2020
Pag 2
CONCLUSION
The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics would
prohibit Thomas Hardaway Jr. from obtaining employment for compensation with the governmental
entity in which his mom,Linda Hardaway, serves as an elected official.La.R.S.42:1119B provides
that no member of the immediate family of a member of a governing authority or the chief executive
of a governmental entity shall be employed by the governmental entity. Linda Hardaway is a District
Selectman, and thus, is a member of a governing authority. As such, her son, Thomas Hardaway, is
prohibited from obtaining employment with her governmental entity.However,La.R.S.42:1123(30)
provides an exception which will allow Mr.Hardaway to serve as the Assistant Recreational Director
provided that he donates his services and he is not appointed to the position of Assistant Director
of Recreation.
This advisory opinion is based solely on the facts as set forth herein.Changes to the facts as presented
may result in a different application of the provisions of the Code of Ethics. The Board issues no
opinion as to past conduct or as to laws other than the Code of Governmental Ethics. If you have
any questions, please contact me at(800) 842-6630 or(225) 219-5600.
Sincerely,
LOUISIANA BOARD OF ETHICS
Tracy M. ker,
For the Bo.
