• • <br /> La. R.S. 42:1111C(2)(d) provides for payments from nonpublic sources as follows: <br /> C. (2) No public servant and no legal entity in which the public servant exercises <br /> control or owns an interest in excess of twenty-five percent, shall receive any thing <br /> of economic value for or in consideration of services rendered, or to be rendered, <br /> to or for any person during his public service unless such services are: <br /> (d)Neither performed for nor compensated by any person from whom such public <br /> servant would be prohibited by R.S. 42:1115(A)(1) or(B) from receiving a gift. <br /> CONCLUSION <br /> Based on the facts presented, Section 1111A the Code of Governmental Ethics would not prohibit <br /> you from consulting with the MDOC since you would not be providing any service which is part <br /> of your Louisiana public duties for OJJ or LDOC. Additionally, Section 1111 C2(d) of the Code <br /> would not prohibit you from consulting with the MDOC. According to the definition in Section <br /> 1102 (16), MDOC is not a person, because it is a government agency. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different application of the provisions of the Code of Ethics.
