Even though your compensation as the ICE Institute's managing director originates from <br /> private sources, your continued operation as the ICE Institute's managing director while <br /> acting as a CPC Commissioner would be prohibited by La. RS. 42:1111(C)(2)(d) and La. R.S. <br /> 42:1111(E). <br /> C. Can the CPC enter into a 2020 contract with the ICE Institute <br /> while I simultaneously serve as the ICE Institute's paid <br /> contractual managing director? <br /> No. While the ICE Institute would be free to enter into a contract with the CPC,you would be <br /> prohibited from serving as both ICE Institute's managing director and CPC commissioner, in <br /> accordance with La.R.S.42:1111(C)(2)(d)and La.R. S.42:1111(E). <br /> D. Can the ICE Institute apply for future grants if I <br /> simultaneously serve as a parish commissioner and as the ICE <br /> Institute's paid contractual managing director? <br /> See the Response to Question C (above). <br /> E. Can I vote on any appropriations to the ICE Institute if I am <br /> serving as its paid contractual managing director? <br /> No. La.RS.42:1120 requires that you recuse yourself on any vote concerning the Ice Institute. <br /> F. During the budget process, can I vote on a fund if it includes <br /> an appropriation to the ICE Institute while simultaneously <br /> serving as the ICE Institute's paid contractual managing <br /> director? <br /> No. La.RS.42:1120 requires that you recuse yourself on any vote concerning the Ice Institute. <br /> G. Does the answer for any of the above change if I work for the <br /> ICE Institute without a salary? <br /> Yes. If you or BCMS do not earn a salary or other form of compensation for performing <br /> managing director duties for ICE Institute, the Code permits you to donate your managing <br /> director services to ICE Institute. However, La. RS. 42:1120 would still require that you <br /> recuse yourself from any vote concerning Ice Institute. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Governmental <br /> Ethics. The Board issues no opinion as to past conduct or as to laws other than the Code of <br /> Governmental Ethics,the Campaign Finance Disclosure Act,the Lobbyist Disclosure Act,and <br /> conflict of interest provisions in the gaming laws.
