R.S. 42:1ll5A No public servant shall solicit or accept, directly or <br /> indirectly,any thing of economic value as a gift or gratuity from any person or from <br /> any officer,director,agent,or employee of such person,if such public servant knows <br /> or reasonably should know that such person: (1) Has or is seeking to obtain <br /> contractual or other business or financial relationships with the public servant's <br /> agency. <br /> (c) La. R.S. 42:1ll2B(3) states that no public servant shall participate in a <br /> transaction involving the governmental entity in which,to his actual knowledge,any <br /> person of which he is an officer, director, trustee, partner, or employee has a <br /> substantial economic interest. <br /> (d) La.R.S.39:1211 provides the term, "local depositing authorities", includes all <br /> parishes, municipalities, boards, commissions, sheriffs and tax collectors,judges, <br /> clerks of court,and any other public bodies or officers of any parish,municipality or <br /> township, but it does not include the state and its elected officials, and state <br /> commissions, boards, and other state agencies. <br /> (e) La. R.S. 39:1233.1 Notwithstanding any provision of Chapter 15 of Title 42 of <br /> the Revised Statutes of 1950 or any other law to the contrary, any member of a local <br /> depositing authority, including the chief executive officer thereof, may serve as an <br /> officer, director, or employee,whether compensated or not, of any national or state <br /> bank;provided that he shall recuse himself from voting in favor of any such bank and <br /> shall disclose the reason for such recusal by filing same into the minutes or record of <br /> the local depositing authority and by forwarding a disclosure form to the Board of <br /> Ethics. <br /> (� La. R.S. 42:ll02(12) "Governmental entitv" means the state or any political <br /> subdivision which employs the public employee or employed the former public <br /> employee or to which the elected official is elected, as the case may be. <br /> (g)La.R.S.42:1102(16)defines" erson"to mean an individual or legal entity other <br /> than a governmental entity, or an agency thereof. <br /> (h)La.R.S.42:1102(17)"Political subdivision"means any unit of local government, <br /> including a special district, authorized by law to perform governmental functions. <br /> (i)La.R.S.42:1102(18)"Public Em�lo�"to mean anyone,whether compensated <br /> or not, who is (I) an administrative officer or official of a governmental entity who <br /> is not filling an elective office.
