Agency Tracking No. 2023-417 Page 8 of 12 As an appointed member of the Madison Parish Hospital Service District Board of Commissioners, Mr. Norris is a public servant as defined by La. R.S. 42:1102(18) and (19). His agency, as defined by La. R.S. 42:1102(a)(iv), is the Madison Parish Hospital Service District. The Madison Parish Hospital Service District is a governing authority as defined by La.R.S. 42:ll02(11) and the District is a governmental entity as defined by La. R.S. 42:1102(12). As an appointed member of the District Board of Commissioners,Mr.Norris was a member of a governing authority. Madison Parish Hospital Service District is a local depositing authority as defined by La. R.S. 39:1211. Delta Bank is a person as defined by La.R.S.42:1102(16). At all times pertinent herein,Mr. Norris was an employee of Delta Bank. At all times pertinent herein, Delta Bank had a contractual, financial and business relationship with Madison Parish Hospital Service District. As a public servant,Mr.Norris was prohibited from receiving a thing of economic value for services rendered to a person that has a contractual, financial or business relationship with his agency. Therefore, Mr.Norris,while serving as a member of the Madison Parish Hospital Service District, was prohibited from receiving compensation for services rendered to Delta Bank while Delta Bank had a contractual, financial and business relationship with the District. La. R.S. 39:1233.1 provides an exception that allows members of local depositing authorities to receive compensation from persons that have contractual, financial or business relationships with the local depositing authority; however, the member must recuse himself from participating in matters in which the person has a substantial economic interest and file disclosure statements with the BOE disclosing each recusaL Mr.Norris failed to comply with La.R.S. 39:1233.l;therefore,he violated La. R.S. 42:1111C(2)(d).
