Box 2055 <br /> Monroe, LA 71207 <br /> Re: Ethics Board Docket No. 2016-1049 <br /> Dear Mr. Inabnett: <br /> The Louisiana Board of Ethics, at its December 16, 2016 meeting, considered your <br /> request for an advisory opinion, submitted on behalf of your clients, Sarah Allbritton and <br /> Medical Temps, Inc., regarding whether Medical Temps may enter into a contract with <br /> Morehouse General Hospital (the "Hospital") given the change in circumstances since the <br /> Consent Opinion was executed in Docket Number 2011-854. You provided the <br /> following background information for consideration in connection with your request: <br /> James Allbritton, Mrs. Allbritton's husband, terminated his employment as Chief <br /> Financial Officer of the Hospital on August 30, 2016. Thereafter, the Hospital contacted <br /> Medical Temps and requested that it enter into a temporary staffing contract to supply <br /> personnel to the Hospital as needed. Mr. Allbritton has no ongoing or future duties or <br /> responsibilities to the Hospital, and no ongoing or future contract for the rendition of <br /> services to the Hospital, whether as an employee, contractor, consultant, agent, or other <br /> representative of the Hospital. Mr. and Mrs. Allbritton remain completely separate in <br /> property. Mr. Allbritton does not have any shareholder or other ownership or interest of <br /> any nature whatsoever in Medical Temps. Additionally, Mr. Allbritton is not an officer, <br /> director, employee, independent contractor, consultant, agent, or other representative of <br /> Medical Temps. However, Mr. Allbritton occasionally consults with Mrs. Allbritton <br /> regarding Medical Temps on accounting, human resource. and business dealing issues, <br /> always informally and always without any compensation, and he will continue to do so <br /> for the foreseeable future. Nevertheless, Mrs. Allbritton will not formally or informally <br /> consult with Mr. Allbritton, whether for compensation or without any compensation, <br /> regarding the negotiation and operations of any contract with the Hospital for a period of <br /> two years from August 30, 2016. <br /> The Board concluded, and instructed me to inform you, that the Code of Governmental <br /> Ethics would not prohibit Medical Temps from entering into a temporary staffing <br /> contract with the Hospital. La. R.S. 42:1121A(1) prohibits a former agency head, for a <br /> period of two years following the termination of his public service as the head of such <br /> agency, from assisting another person, for compensation, in a transaction, or in an <br /> appearance in connection with a transaction, involving that agency or rendering any <br /> service on a contractual basis to or for such agency.
