Box 307 <br /> Livonia, LA 70755 <br /> Re: Ethics Board Docket No.2016-1043 <br /> Dear Mayor Chustz: <br /> The Louisiana Board of Ethics,at its December 16,2016 meeting,considered your request for an advisory <br /> opinion as to whether the Town of Livonia may continue to conduct business with Livonia Auto Repair, <br /> LLC.You stated that Gregory Jarreau was recently elected as a member of the Livonia Town Council.You <br /> also stated that the Town of Livonia has engaged the services of Livonia Auto Repair,LLC for repair and <br /> service of the town's vehicles on multiple occasions in the past. Finally,you stated that Livonia Auto Repair, <br /> LLC is owned solely by Dudley and Vicki Jarreau,the brother and sister-in-law of Gregory Jarreau. You <br /> provided information that Livonia has a population of approximately 1,442 according to the 2010 federal <br /> census. In addition, Livonia is located within Pointe Coupee Parish which has a population of 22,802 <br /> according to the 2010 federal census. <br /> The Board concluded,and instructed me to inform you,that the Code of Governmental Ethics would prohibit <br /> Livonia Auto Repair,LLC from continuing to provide services to the Town of Livonia while Gregory Jarreau <br /> serves as a member of the Livonia Town Council. La. R.S. 42:1113A(1)(a) prohibits public servants, <br /> excluding any legislator and any appointed member of any board or commission and any member of a <br /> governing authority of a parish with a population of ten thousand or less,their immediate family members, <br /> or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or <br /> other transaction that is under the supervision or jurisdiction of the agency of such public servant.La.R.S. <br /> 42:1102(13)defines "immediate family” members of a public servant to mean,his children,the spouses of <br /> his children, his brothers and their spouses, his sisters and their spouses, his parents, his spouse, and the <br /> parents of his spouse. Therefore, Livonia Auto Repair, LLC, a company solely owned by the brother and <br /> sister-in-law of Gregory Jarreau, is prohibited from providing services to the Town of Livonia while he <br /> serves as a member of the Livonia Town Council. Family members of a council member or entities which <br /> they own do not fall within the exception cited in your request pertaining to municipalities with a population <br /> of five thousand or less. <br /> This advisory opinion is based solely on the facts as set forth herein.Changes to the facts as presented may <br /> result in a different application of the provisions of the Code of Ethics. The Board issues no opinion as to <br /> past conduct or as to laws other than the Code of Governmental Ethics.
