Price <br /> 16485 Keystone Blvd. <br /> Prairieville, LA 70769 <br /> Re: Ethics Board Docket No. 2017-178 <br /> Dear Ms. Price: <br /> The Louisiana Board of Ethics, at its March 17, 2017 meeting, considered your request for an <br /> advisory opinion regarding your professional cleaning business, KP3 Dimension Cleaning <br /> Service, LLC. You stated that you are currently employed with the Office of State Procurement <br /> as a State Purchasing Officer and your job duties include the procurement and review of <br /> contracts for the State of Louisiana. You also stated that you own a professional cleaning <br /> business, KP3 Dimension Cleaning Service, LLC, which services residential and commercial <br /> properties including churches, restaurants, fraternity/sorority buildings, residential homes and <br /> apartment complexes. You provided further information that KP3 Dimension Cleaning Service, <br /> LLC is not an approved vendor for the State of Louisiana. You inquired as to whether you would <br /> be prohibited from seeking government funded contracts for your cleaning business and whether <br /> you would be prohibited from marketing the business by placing flyers and business cards in <br /> state buildings. <br /> The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics <br /> does not prohibit you or KP3 Dimension Cleaning Service, LLC from seeking government <br /> funded contracts provided the contract is not with your agency, the Office of State Procurement, <br /> and the contract is not subject to review or approval by your agency. La. R.S. 42:1113A(1)(a) <br /> prohibits public servants, their immediate family members, or legal entities in which they have a <br /> controlling interest, from entering into any contract, subcontract, or other transaction that is <br /> under the supervision or jurisdiction of the agency of such public servant. La. R.S. 42:1112A <br /> prohibits a public servant from participating in a transaction involving his governmental entity in <br /> which he has a substantial economic interest. <br /> The Board concluded, and instructed me to inform you, that there are no provisions in the Code <br /> of Governmental Ethics that would prohibit you from marketing KP3 Dimension Cleaning <br /> Service, LLC by placing flyers and business cards in state buildings. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics. The <br /> Board issues no opinion as to past conduct or as to laws other than the Code of Governmental <br /> Ethics.
