Box 490
Mamou, La. 70554
Re: Ethics Board Docket No. 2017-257
Dear Mayor Fontenot:
The Louisiana Board of Ethics,at its April 21,2017 meeting, considered your request for an
advisory opinion regarding whether the Code of Governmental Ethics would prohibit an attorney
who is serving as a part time Assistant District Attorney for Evangeline Parish from servings as a
Magistrate for Mamou's Mayor Court.
The Board concluded, and instructed me to inform you, under the facts presented, there are
no provisions in the Louisiana Code of Governmental Ethics which would prohibit an attorney from
serving simultaneous as an Assistant District Attorney for a Parish and a Magistrate for a
municipality. However, you should be advised that this opinion request may present an issue
associated with the Louisiana Dual Office-Holding laws, which are under the jurisdiction of the
Attorney General.
This advisory opinion is based solely on the facts as set forth herein. Changes to the facts
presented may result in a different application of the provisions of the Code of Ethics. The Board
issues no opinion as to past conduct or laws other than Code of Governmental Ethics.
