Box 490 <br /> Mamou, La. 70554 <br /> Re: Ethics Board Docket No. 2017-257 <br /> Dear Mayor Fontenot: <br /> The Louisiana Board of Ethics,at its April 21,2017 meeting,considered your request for an <br /> advisory opinion regarding whether the Code of Governmental Ethics would prohibit an attorney <br /> who is serving as a part time Assistant District Attorney for Evangeline Parish from servings as a <br /> Magistrate for Mamou's Mayor Court. <br /> The Board concluded, and instructed me to inform you,under the facts presented,there are <br /> no provisions in the Louisiana Code of Governmental Ethics which would prohibit an attorney from <br /> serving simultaneous as an Assistant District Attorney for a Parish and a Magistrate for a <br /> municipality. However, you should be advised that this opinion request may present an issue <br /> associated with the Louisiana Dual Office-Holding laws, which are under the jurisdiction of the <br /> Attorney General. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts <br /> presented may result in a different application of the provisions of the Code of Ethics.
