Trahan <br /> Jeff Davis Water and Sewer Commission <br /> 5171 Aguillard Rd. <br /> Lake Arthur, La. 70549 <br /> Re: Ethics Board Docket No. 2017-229 <br /> Dear Mr. Trahan: <br /> The Louisiana Board of Ethics,at its April 21,2017 meeting,considered your request for an <br /> advisory opinion regarding whether the Code of Governmental Ethics would prohibit the Jeff Davis <br /> Water and Sewer Commission(Commission) from purchasing a vehicle from Gulf Coast Autoplex <br /> (Autoplex) while the Commission President, Greg Bordelon is employed by the Autoplex. You <br /> provided that Mr. Bordelon is a part time employee of the Gulf Coast Autoplex,has no ownership <br /> interest in the Autoplex, and will not benefit or receive any commission for the sale of this vehicle. <br /> The Board concluded,and instructed me to inform you,that under the facts presented herein <br /> the Jeff Davis Water and Sewer Commission is prohibited from purchasing a vehicle from the <br /> Autoplex while Commission President Bordelon is employed by the Autoplex. La. R.S. <br /> 42:1111 C(2)(d) prohibits a public servant, or a legal entity in which the public servant exercises <br /> control, from receiving a thing of economic value for services rendered to any person whose <br /> conducts operations or activities that are regulated by the public servants agency or has or is seeking <br /> to obtain a business or financial relationship with the public servant's agency. Therefore if the <br /> Autoplex enters a business or financial relationship with the Commission, Mr. Bordelon would be <br /> prohibited from receiving his salary from the Autoplex and the Autoplex would be prohibited from <br /> paying Mr. Bordelon. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics. The Board <br /> issues no opinion as to past conduct or as to laws other than the Code of Governmental Ethics.
