Reggie <br /> The Reggie Law Firm <br /> I Norlhview Lane <br /> Crowley, Louisiana 70526 <br /> Re: Ethics Board Docket No. 2017-505 <br /> Dear Mr. Reggie: <br /> The Louisiana Board of Ethics,at its lune 16,2017 meeting,considered your request for an advisory <br /> opinion regarding whether La. R.S. 42:1113A would prohibit your wife's company,Platinum Realty, from <br /> serving as the broker on a real estate transaction for the Louisiana Motor Vehicle Commission(LMVC) <br /> while you have a contract to supply legal services to the LMVC. You stated that you are an attorney in <br /> private practice that you have a contract to supply legal services on an as needed basis to the LMVC. You <br /> stated that under the terms of your contract, you have not and will not supply any legal services to LMVC <br /> regarding the purchase of the new building. You added that LMVC would not be required to provide any <br /> legal services toward the purchase of the building. The Division of Administration would be required to <br /> approve any purchase of real property by LMVC. <br /> You stated that your wife owns, Platinum Realty, a Louisiana licensed real estate agency that <br /> employs several real estate agents, including yourself It is your understanding that LMVC is considering <br /> the purchase of a new building to house the agency. Additionally, you added that neither you nor your <br /> wife would act as the real estate agent on the sale of the property or receive a commission related to the sale <br /> of the property. However, you did disclose that the company, Platinum Realty, would like to retain the <br /> broker's portion of the commission earned on the transaction with LMVC. <br /> The Board concluded, and instructed me to inform you, that La. R.S.42:1113A would not prohibit <br /> Platinum Realty from serving as the broker on a transaction with LMVC. La. R.S. 42:111314 prohibits a <br /> public servant,a member efhis immediate family or a legal entity in which either Gyms a controlling interest, <br /> from bidding on or entering into a contract, subcontract or transaction that is under the supervision or <br /> jurisdiction of the public servant's agency.Since your contract to provide legalservicesdoes not include any <br /> legal services regarding the purchase of real property Platinum Realty would not be transacting with your <br /> agency. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics. The Board issues no <br /> opinion as to past conduct or as to laws other than the Code of Governmental Ethics.
