You provided information that you are <br /> currently employed as an Assistant City Engineer with the Department of Engineering and <br /> Environmental Services within the City of Shreveport and also operate your own private <br /> landscape/engineering company during the time that you are not working for the City of Shreveport. <br /> You stated that James Martin, a developer, recently approached you requesting that you submit a <br /> proposal to perform engineering work for his upcoming development located outside of the City of <br /> Shreveport. You also stated thatJames Martin is currently working on projects that he has contracted <br /> with the City of Shreveport to perform involving the Department of Engineering and Environmental <br /> Services, and you expect him to continue doing work in this capacity in the future. <br /> The Board concluded,and instructed me to inform,that the Louisiana Code of Governmental Ethics <br /> would prohibit you from providing compensated services to James Martin while you are employed <br /> with the Department of'Engineering and Environmental Services within the City of Shreveport. <br /> La. R.S. 42:1111C(2)(d) prohibits a public servant from performing compensated services for a <br /> person that has or seeks to have a business. financial or contractual relationship with the public <br /> servant's agency. Because lames Martin has or may seek to have a business, financial or contractual <br /> relationship with your agency, you are prohibited from providing compensated services to James <br /> Martin. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different application of the provisions of the Code of Ethics. The Board issues <br /> opinion as to past conduct or laws other than Code of Governmental Ethics.
