Box 728 <br /> Greensburg, Louisiana 70441 <br /> Re: Ethics Board Docket No. 2017-449 <br /> Dear Mr. Speed: <br /> The Louisiana Board of Ethics, at its June 16,2017 Board meeting, considered your request for an <br /> advisory opinion on behalf of the Town of Greensburg Mayor Paula McNabb regarding whether <br /> Annie Ficklin may be employed as the Town Clerk.Ms. Ficklin currently serves as the Town Clerk <br /> after being appointed to the position on September 22, 2016. You stated that neither Mayor Paula <br /> McNabb nor any of the Greensburg Board of Aldermen are considered immediate family members <br /> of Annie Ficklin. Amanda Ficklin Mixon serves as a Greensburg Alderwoman; and, she is the first <br /> cousin of Annie Ficklins husband. <br /> The Board concluded, and instructed me to inform you, that the Louisiana Code of Governmental <br /> Ethics would not prohibit Annie Ficklin from serving as the Town Clerk for Greensburg when none <br /> of her immediate family members serve as the Mayor or Board of Aldermen for the Town of <br /> Greensburg. La. R.S. 42:1102(13) provides that "immediate family" as the term relates to a public <br /> servant means his children,the spouses of his children,his brothers and their spouses,his sisters and <br /> their spouses, his parents,his spouse,and the parents of his spouse. La B.S.42:1119B(1)provides <br /> that no member of the immediate family of a memberofa governing authority or the chief executive <br /> of a governmental entity shall be employed by the governmental entity. No immediate family <br /> members ofAtmie Ficklin. as defined in La. R.S. 42:1102(13), serve as a member of the governing <br /> authority or the mayor of the Town of Greensburg. As such, she would not be prohibited from <br /> serving as the Town Clerk of Greensburg. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts presented <br /> may result in a different application of the provisions of the Code of Ethics. The Board issues no <br /> opinion as to past conduct or laws other than Code of Governmental Ethics.
