You stated that Mr. Theus <br /> served on the Board of Commissioners for SEDD from September 2015 until January 2017. You <br /> also stated that Mr. Theus has served as the uncompensated Executive Director of SEDD from <br /> June 6, 2016 until present. Finally, you stated that SEDD would now like to hire Mr. Theus as its <br /> Executive Director and compensate him for his services. <br /> The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics <br /> prohibits Charles Theus from serving as the Executive Director of SEDD. La. R.S. 42:1121A(2) <br /> prohibits a former member of a board or commission from contracting with, being employed in <br /> any capacity by, or being appointed to any position by his former board or commission for a <br /> period of two years from the date of his resignation. Therefore, Mr. Theus is prohibited from <br /> serving as the Executive Director of SEDD for two years following the termination of his service <br /> as a member of the Board of Commissioners for SEDD. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics. The <br /> Board issues no opinion as to past conduct or as to laws other than the Code of Governmental <br /> Ethics.
