You stated that <br /> you currently serve as the Special Education Policy Director for the Louisiana Department of <br /> Education, and your job duties include drafting policies related to special education which are <br /> then submitted to BESE. You also stated that you recently took three days of personal leave and <br /> participated in a review panel with the U.S. Department of Education providing peer feedback on <br /> two state specific plans, which did not include Louisiana, for implementing federal education <br /> laws and policies. Finally, you stated that you have never participated in peer reviews in your <br /> capacity as the Special Education Policy Director for the Louisiana Department of Education. <br /> The Board concluded, and instructed me to inform you, that the Code of Governmental Ethics <br /> would not prohibit you from accepting an honorarium from the U.S. Department of Education <br /> for your participation in a review panel on May 22-24, 2017. La. R.S. 42:1111C(1)(a)prohibits a <br /> public servant from receiving any thing of economic value for any service, the subject matter of <br /> which is devoted substantially to the responsibilities, programs, or operations of the agency of <br /> the public servant and in which the public servant has participated. Because you provided peer <br /> feedback for matters unrelated to your public job duties and for which you have not participated, <br /> no violation of the Code of Governmental Ethics would be presented. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics. The <br /> Board issues no opinion as to past conduct or as to laws other than the Code of Governmental <br /> Ethics.
