Advisory opinion that the Code of Governmental Ethics would not prohibit the continued employment of an employee of Lake Charles Office Supply if the employee was elected Mayor of Sulphur at a time when Lake Charles Office Supply does business with the City of Sulphur, since the emlpoyee would meet the four factors in 82-02D. However, the employee would be prohibited from participating in any matters involving the City of Sulphur and Lake Charles Office Supply and a disclosure form in accordance with La. R.S. 42:1114 would be required to be filed by May 15th.

Danahay: <br /> The Louisiana Board of Ethics, at its August 18, 2017 meeting, considered your request for an <br /> advisory opinion as to whether should you be elected as the Mayor of Sulphur,you may continue to <br /> work for Lake Charles Office Supply (LCOS) which does business with the City of Sulphur. You <br /> stated that you are a field sales representative with LCOS. Your duties include recruiting new client <br /> accounts to generate sales and maintain existing accounts. You further stated that you do not have <br /> an ownership interest in LCOS and as a part-time employee your compensation would be a fixed <br /> monthly salary with no year-end bonus. <br /> You stated that LCOS has and continues to conduct business with the City of Sulphur,however that <br /> account is serviced by another sales representative. You further stated that if you are elected Mayor <br /> of Sulphur you would like to remain with LCOS on a part-time basis. <br /> The Board concluded and instructed me to inform you that the Code of Governmental Ethics would <br /> not prohibit your continued employment with LCOS should you be elected Mayor of Sulphur at a <br /> time when LCOS does business with the City of Sulphur. La.R.S.42:1111C(2)(d)provides that no <br /> public servant and no legal entity in which the public servant exercises control or owns an interest <br /> in excess of twenty-five (25%) percent, shall receive any thing of economic value for or in <br /> consideration of services rendered, or to be rendered,to or for any person during his public service <br /> unless such services are: (d) Neither performed for nor compensated by any person or from any <br /> officer,director,agent,or employee of such person,if such public servant knows or reasonably should <br /> know that such person has or is seeking to obtain contractual or other business or financial <br /> relationships with the public servant's agency.
