Gaab <br /> Plauche, Smith&Nieset,L.L.C. <br /> 1123 Pithon Street <br /> Lake Charles, LA 70601 <br /> RE: Ethics Board Docket No. 2017-679 <br /> Dear Mr. Gaab: <br /> The Louisiana Board of Ethics, at its August 18, 2017 meeting, considered your request for an <br /> advisory opinion concerning the imposition of post-employment restrictions relative to former <br /> Calcasieu Police Jurors who would like to engage in transactions with special service districts created <br /> by Calcasieu Parish.You stated that Calcasieu Parish operates under the unit system of government <br /> and is governed by a fifteen (15) member police jury vested with policy making and legislative <br /> authority. You further provided that several police jurors own businesses in Calcasieu Parish and that <br /> they are aware of the prohibition established by La. R.S. 42:1113(A) relative to any of them <br /> contracting to do business with the parish or any of the special service districts created by the police <br /> jury. <br /> You stated that a few of the police jurors will be leaving office in the near future. You further stated <br /> that you are aware of ethics opinions which have addressed the definition of agency under La. R.S. <br /> 42:1113(A),concluding that the agency includes special service districts created by the Police Jury. <br /> However, you are not clear as to the definition of agency and the inclusion of the above referenced <br /> special service districts in the prohibitions contained in La. R.S. 42:1121 during the two (2) year <br /> period after police jurors leave office. <br /> The Board concluded and instructed me to inform you that the Code of Governmental Ethics would <br /> prohibit former police jurors from engaging in transactions with special service districts created by <br /> Calcasieu Parish for a two(2)year period after they leave office.La R.S.42:1121A(1)provides that <br /> no former agency head or elected official shall, for a period of two years following the termination <br /> of his public service as the head of such agency or as an elected public official serving in such agency, <br /> assist another person, for compensation, in a transaction, or in an appearance in connection with a <br /> transaction,involving that agency or render any service on a contractual basis to or for such agency. <br /> Page l of 2 <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
