Schudmak,III <br /> 1190 East Airline Highway <br /> Laplace,Louisiana 70123 <br /> Re: Louisiana Board of Ethics <br /> Docket No. 2017-743 <br /> Dear Mr. Schudmak, <br /> The Louisiana Board of Ethics, at its August 18, 2017, meeting, considered your request for an <br /> advisory opinion as to whether the Code of Governmental Ethics (Code) would prohibit you <br /> from providing services to the Jefferson Parish Government. <br /> You stated that you were appointed by Jefferson Parish Councilman Paul Johnson as a member <br /> of the Jefferson Parish Finance Authority (Authority). The Authority is a public trust which pro- <br /> vides financing of mortgage loans on single family residential property. The Authority is gov- <br /> erned by an independent Board of Trustees,of which you are a member. <br /> You provided that you are also the co-owner of Bed Liners of Metairie, LLC d/b/a Rhino Lin- <br /> ings of Metairie. You ask whether Rhino Linings of Metairie may provide services to the Jeffer- <br /> son Parish Government, specifically, the Fleet Management Department. You stated that no ser- <br /> vices would be provided to the Authority. <br /> The Board concluded, and instructed me to inform you, that you and your business, Rhino Lin- <br /> ings of Metairie, would not be prohibited from entering into contracts or transactions with the <br /> Jefferson Parish Government, Fleet Management Department. La. R.S. 42:1113B provides that <br /> no appointed member of any board or commission, member of his immediate family, or legal <br /> entity in which he has a substantial economic interest shall bid on or enter into or be in any way <br /> interested in any contract, subcontract, or other transaction which is under the supervision or ju- <br /> risdiction of the agency of such appointed member. Since no services would be provided to the <br /> Authority, you and Rhino Linings of Metairie would not be prohibited from entering into con- <br /> tracts or transactions with the Jefferson Parish Government,Fleet Management Department. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as pre- <br /> sented may result in a different application of the provisions of the Code of Governmental Eth- <br /> ics. The Board issues no opinion as to past conduct or as to laws other than the Code of Gov- <br /> ernmental Ethics, the Campaign Finance Disclosure Act, the Lobbyist Disclosure Act, and con- <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
