Box 799
Natchitoches,Louisiana 71458-0779
Re: Louisiana Board of Ethics
Docket No.2017-1233
Dear Mr. Nowlin,
The Louisiana Board of Ethics, at its December 15, 2017, meeting, considered your request for
an advisory opinion as to whether Section 1119 of the Code of Governmental Ethics (Code)
would prohibit Natchitoches Parish from hiring the step-son of a current Parish Councilman.
You provided that Natchitoches Parish is currently seeking to fill the vacant position of Director
of Public Works. One of the applicants is Cody Martin, who is the step-son of Natchitoches
Parish Councilman Rodney Bedgood.
La. R.S. 42:1119A provides that no member of the immediate family of an agency head shall be
employed in his agency. La. R.S. 42:1102(13) defines "immediate family," as it relates to the pub-
lic servant, as his children, spouses of his children, his brothers and their spouses, his sisters and
their spouses, his parents, his spouse, and the parents of his spouse.
As a result, the Board concluded, and instructed me to inform you, that Cody Martin would not
be prohibited from being employed by Natchitoches Parish while his step-father serves as an
elected member of the Natchitoches Parish Council.
This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as pre-
sented may result in a different application of the provisions of the Code of Governmental Eth-
ics. The Board issues no opinion as to past conduct or as to laws other than the Code of Gov-
ernmental Ethics, the Campaign Finance Disclosure Act, the Lobbyist Disclosure Act, and con-
flict of interest provisions in the gaming laws. If you have any questions, please contact me at
(800)842-6630 or(225)219-5600.
Sincerely,
LOUISIANA BOARD OF ETHICS
♦
David M.
