Box 799 <br /> Natchitoches,Louisiana 71458-0779 <br /> Re: Louisiana Board of Ethics <br /> Docket No.2017-1233 <br /> Dear Mr. Nowlin, <br /> The Louisiana Board of Ethics, at its December 15, 2017, meeting, considered your request for <br /> an advisory opinion as to whether Section 1119 of the Code of Governmental Ethics (Code) <br /> would prohibit Natchitoches Parish from hiring the step-son of a current Parish Councilman. <br /> You provided that Natchitoches Parish is currently seeking to fill the vacant position of Director <br /> of Public Works. One of the applicants is Cody Martin, who is the step-son of Natchitoches <br /> Parish Councilman Rodney Bedgood. <br /> La. R.S. 42:1119A provides that no member of the immediate family of an agency head shall be <br /> employed in his agency. La. R.S. 42:1102(13) defines "immediate family," as it relates to the pub- <br /> lic servant, as his children, spouses of his children,his brothers and their spouses, his sisters and <br /> their spouses,his parents,his spouse,and the parents of his spouse. <br /> As a result, the Board concluded, and instructed me to inform you, that Cody Martin would not <br /> be prohibited from being employed by Natchitoches Parish while his step-father serves as an <br /> elected member of the Natchitoches Parish Council. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as pre- <br /> sented may result in a different application of the provisions of the Code of Governmental Eth- <br /> ics. The Board issues no opinion as to past conduct or as to laws other than the Code of Gov- <br /> ernmental Ethics, the Campaign Finance Disclosure Act, the Lobbyist Disclosure Act, and con- <br /> flict of interest provisions in the gaming laws.
