As Command Historian,
your duties include researching, organizing, and interpreting Louisiana militia and National
Guard history through the use and display of public reports, files, and documents. You also as-
sist researchers with library and archive resources, as well as conduct oral histories with soldiers,
airmen, veterans, and any other appropriate parties who may contribute to the history of the
Louisiana National Guard.
You are interested in writing and selling a book detailing the esteemed history of the Louisiana
National Guard. You stated that all of your source material would be public documents. Addi-
tionally, you stated that any new research and all writing would be conducted outside of your
normal working hours at the Louisiana National Guard Museum.
The Board conduded, and instructed me to inform you, that, generally, the Code would not
prohibit you from receiving compensation from the sale of your book as you have not partici-
pated in, and your duties as Command Historian do not include, the authorship and publication
of a book regarding the Louisiana National Guard. R.S. 42:1111C(1)(a) prohibits a public
servant from receiving anything of economic value for any service, the subject matter of which
is devoted substantially to the responsibilities, programs,or operations of the agency of the pub-
lic servant and in which the public servant has participated.
However, please be aware that, in the event you are able to publish and sell the book, La. R.S.
42:1111C(2)(d) would prohibit you from receiving compensation from prohibited sources, in-
AN EQUAL OPPORTUNITY EMPLOYER
