Boyer <br /> Boyer,Hebert,Abels &Angelle,LLC <br /> 1280 Del Este Avenue <br /> Denham Springs,LA 70726 <br /> RE: Ethics Board Docket No. 2017-832 <br /> Dear Mr. Boyer: <br /> The Louisiana Board of Ethics, at its December 15, 2017 meeting, considered your request for an <br /> advisory opinion as to whether the daughter of a member of the Livingston Parish School Board <br /> could be employed as a substitute bus driver for the Livingston Parish School Board. <br /> You stated that the Livingston Parish School Board employs a seniority system for the selection of <br /> permanent bus drivers after it has allowed the senior most and tenured bus drivers to select vacant <br /> routes. You further stated that the school board member's daughter would like to eventually become <br /> a permanent bus driver. <br /> The Board concluded and instructed me to inform you that the Code of Governmental Ethics would <br /> prohibit the daughter of a member of the Livingston Parish School Board from being employed as <br /> a substitute bus driver for the Livingston Parish School Board. La.R.S.42:1119A provides that no <br /> . member of the immediate family of an agency head shall be employed in his agency. La. R.S. <br /> 42:1102(13) defines "immediate family" to include the child of the public servant. The Code of <br /> Governmental Ethics would prohibit the school board member's daughter from being employed as <br /> a substitute bus driver in his agency(school board). <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as <br /> presented may result in a different application of the provisions of the Code of Ethics. The Board <br /> issues no opinion as to past conduct or as to laws other than the Code of Governmental Ethics.
