Boyer
Boyer,Hebert,Abels &Angelle,LLC
1280 Del Este Avenue
Denham Springs,LA 70726
RE: Ethics Board Docket No. 2017-832
Dear Mr. Boyer:
The Louisiana Board of Ethics, at its December 15, 2017 meeting, considered your request for an
advisory opinion as to whether the daughter of a member of the Livingston Parish School Board
could be employed as a substitute bus driver for the Livingston Parish School Board.
You stated that the Livingston Parish School Board employs a seniority system for the selection of
permanent bus drivers after it has allowed the senior most and tenured bus drivers to select vacant
routes. You further stated that the school board member's daughter would like to eventually become
a permanent bus driver.
The Board concluded and instructed me to inform you that the Code of Governmental Ethics would
prohibit the daughter of a member of the Livingston Parish School Board from being employed as
a substitute bus driver for the Livingston Parish School Board. La.R.S.42:1119A provides that no
. member of the immediate family of an agency head shall be employed in his agency. La. R.S.
42:1102(13) defines "immediate family" to include the child of the public servant. The Code of
Governmental Ethics would prohibit the school board member's daughter from being employed as
a substitute bus driver in his agency(school board).
This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as
presented may result in a different application of the provisions of the Code of Ethics. The Board
issues no opinion as to past conduct or as to laws other than the Code of Governmental Ethics. If
you have any questions,please contact me at(800) 842-6630 or(225) 219-5600.
Sincerely,
LOUISIANA BOARD OF ETHICS
Aoi
Gregory ibodeaux
For the Board
AN EQUAL OPPORTUNITY EMPLOYER
