Victor Blvd. <br /> Suite 100 <br /> Morgan City, Louisiana 70380 <br /> Re: Ethics Board Docket No. 2017-1168 <br /> Dear Dr. Morice: <br /> The Louisiana Board of Ethics, at its December 15, 2017 Board meeting, considered your request <br /> for an advisory opinion as to whether you could serve as Deputy Coroner of St. Mary Parish and <br /> serve as a board member of the Hospital Service District No.2 in St. Mary Parish and whether you <br /> could engage in a relationship with St.Mary Parish Government wherein you would be one of the <br /> preferred providers of medical care for St.Mary Parish Government employees. You stated that you <br /> were recently appointed as Deputy Coroner of St. Mary Parish and that you also serve as a Jury <br /> Commissioner on the Board of Commissioner of Hospital Service District No.2 in St.Mary Parish. <br /> You further stated that you are one of the preferred providers of medical care for St. Mary Parish <br /> Government employees and that you were following in the footsteps of a former Deputy Coroner for <br /> St.Mary Parish who was also a preferred provider of medical care for employees of St.Mary Parish <br /> Government. <br /> You requested an opinion relative to two issues: (1)Whether you could serve as Deputy Coroner for <br /> St. Mary Parish while at the same time serving as a board member of the Hospital Service District <br /> No.2 in St.Mary Parish,and(2)Whether you as Deputy Coroner for St.Mary Parish could engage <br /> in a relationship with the St. Mary Parish Government wherein you would be one of the preferred <br /> providers of medical care for the employees of St. Mary Parish Government? <br /> As to the first issue,the Board declined to render an opinion as to whether you could act as a Deputy <br /> Coroner for St. Mary Parish while serving as a board member of the Hospital Service District No. <br /> 2 in St. Mary Parish because this issue concerns the law of Dual Office Holding and is not within <br /> the jurisdiction of the Board of Ethics. The Louisiana Attorney General's Office would be the proper <br /> agency to provide you with information concerning dual office holding. <br /> As to the second issue, the Board concluded and instructed me to inform you that the Code of <br /> Governmental Ethics would not prohibit you from acting as Deputy Coroner for St.Mary Parish and <br /> being a preferred provider of medical care for employees of St.Mary Parish Government. La.R.S. <br /> 42:1113A(1)(a) prohibits a public servant, or member of his immediate family, or legal entity in <br /> which he has a controlling interest from bidding on or entering into any contract, subcontract, or <br /> AN EQUAL OPPORTUNITY EMPLOYER <br />
