Alexis, III <br /> 704 Carondelet Street <br /> New Orleans,Louisiana 70130-3774 <br /> Re: Louisiana Board of Ethics Docket No. 2017-735(2) <br /> Dear Mr. Alexis: <br /> The Louisiana Board of Ethics, at its December 15, 2017 Board meeting, considered your request <br /> for reconsideration of an advisory opinion regarding the reporting requirements associated with a <br /> flyer distributed in opposition to a proposition for the April 29,2017 election that would affect the <br /> Third District Volunteer Fire Department. If passed, this proposition would have terminated the <br /> Department's contract with Jefferson Parish Fire Protection District No. 3. Jody Sanderson is a <br /> Department member who entered into an agreement with LeBlanc&Schuster Public Relations Inc. <br /> to print and mail the flyers. The cost of the mailing and fliers was $4,366.33 and no payment has <br /> been made to LeBlanc& Schuster.Mr. Sanderson has requested that the Department pay all or part <br /> of his obligation. The Department is interested in soliciting donations to offset the costs of paying <br /> the total bill related to the flyers. <br /> The Board concluded,and instructed me to inform you,that the Campaign Finance Disclosure Act <br /> would require Jody Sanderson or any person who made an expenditure in opposition to the <br /> proposition submitted to the voters on April 29, 2017 in Jefferson Parish to file reports of <br /> contributions and expenditures. <br /> La. R.S. 18:1486A provides that any person,including a political committee, who receives <br /> and accepts any contribution,loan,or transfer of funds,or makes any expenditure in support <br /> of or in opposition to a proposition or question submitted to the voters shall be required to <br /> file reports of such contributions and expenditures.Specifically,La.R.S. 18:1486B provides <br /> that required reports with regard to expenditures made in support of or in opposition to a <br /> proposition or question submitted to the voters by a person shall be applicable only if the <br /> aggregate amount of expenditures made equals or exceeds one thousand dollars. <br /> The reports required of the Jody Sanderson, or any person who made expenditures totaling one <br /> thousand or more dollars in opposition to the proposition, would disclose all contributions and <br /> expenditures associated with the opposition to a proposition and should be filed by the schedule set <br /> out in La.
