His daughter,Jolie Boudreaux, is in- <br /> terested in applying for the position of Library Director in the event the position becomes va- <br /> cant. The Library Board is responsible for hiring the Library Director. <br /> La. R.S. 42:1119A(1)(a) provides that no member of the immediate family of an agency head <br /> shall be employed in his agency. La. R.S. 42:1102(3) defines "agency head" to include any mem- <br /> ber of a board or commission who exercises supervision or jurisdiction over the agency. La. R.S. <br /> 42:1102(13) defines an"immediate family member" to include a public servant's child. <br /> As a result, the Board concluded, and instructed me to inform you, that Jolie Boudreaux would <br /> be prohibited from being hired as the Library Director, or to any other position,with the Library <br /> Board while her father,Jamie Boudreaux,serves as a Commissioner. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts as pre- <br /> sented may result in a different application of the provisions of the Code of Governmental Eth- <br /> ics. The Board issues no opinion as to past conduct or as to laws other than the Code of Gov- <br /> ernmental Ethics, the Campaign Finance Disclosure Act, the Lobbyist Disclosure Act, and con- <br /> flict of interest provisions in the gaming laws.
