Tyler <br /> 323 Los Adais Road <br /> Frierson, Louisiana 71027 <br /> Re: Louisiana Board of Ethics Docket No. 2017-1274 <br /> Dear Mr. Tyler: <br /> The Louisiana Board of Ethics,at its January 19,2018 meeting,considered your request for <br /> an advisory opinion regarding whether the Code of Governmental Ethics would prohibit you from <br /> bidding on or entering into a contract to supply lawn services to the Desoto Parish Library System <br /> while your wife is employed by the Desoto Parish Library System. The Desoto Parish Library has <br /> four branches.Your wife,Emily Frances Tyler,is employed as a Library Assistant for the Mansfield <br /> Main Library. She is not the Branch Manager.You stated that you have a separate business account <br /> that does not include your wife. Additionally, you stated that the Branch Managers supervise the <br /> lawn service at each of the four locations. <br /> The Board concluded,and instructed me to advise you,that under the specific circumstances <br /> presented above,La.R.S.42:1113A would not prohibit you from seeking a contract with the Desoto <br /> Parish Library System to provide lawn services at the all of the locations except the Mansfield Main <br /> Branch,as that is your wife's agency. La.R.S. 42:1113A prohibits a public servant or a member of <br /> such public servant's immediate family or a legal entity in which he has controlling interest from <br /> bidding on or entering into any contract,subcontract or other transaction that is under the supervision <br /> or jurisdiction of the public servant's agency. As such, La. R.S. 42:1113A prohibits you from <br /> entering any contract under the supervision of the Branch Manager at the Mansfield Branch of the <br /> Desoto Parish Library. <br /> This advisory opinion is based solely on the facts as set forth herein. Changes to the facts <br /> presented may result in a different application of the provisions of the Code of Ethics. The Board <br /> issues no opinion as to past conduct or laws other than Code of Governmental Ethics.
